If you are a professional, when you create a professional account you are asked to provide us with some data, such as:

• VAT number
• referent name
• email address
• telephone number
• paese
• city

2.2. Data we collect automatically through your use of the Nowarc.com service

This is the personal data that is collected automatically about you when you use the Nowarc.com service and may include:

• Information about the plan type of the Nowarc.com Service.
• Information on your interactions with the Nowarc.com Service, including the date and time of any requests made, pages consulted within the site, showcases created, video content viewed and interactions with other users of Nowarc.com. This information may also include data relating to your use of Third Party Applications and advertising received.
• User Content (as defined in the Terms and Conditions of Use posted on Spotify, including messages sent and/or received through Nowarc.com and interactions with Nowarc.com Customer Service.

To inform you about our commercial activities

We use the data collected, if you have expressly given your consent, to inform you about promotional activities that may be of interest to you. In particular we use them for:

The following personal data will always be available to the public on the Nowarc.com Service: name and/or username, address and geolocation information, telephone number, profile photo and featured photo, email address, VAT number

The provision of personal data is mandatory exclusively for the processing necessary for the provision of the services offered by Nowarc.com (any refusal for the purpose of providing the service makes it impossible to use the service itself); it is instead optional for promotional purposes and any refusal to give consent does not have negative consequences on the provision of the service offered within the website www.nowarc.com.

The data controller is nowarc.com in the legal form of NOWARC SRLS.

6.2. Subjects to whom personal data may be communicated

The data collected as part of the provision of the service may be communicated to:

• companies that carry out functions strictly connected and instrumental to the operation - including technical - of the nowarc.com services, such as providers of mail marketing services.
• Administrative and judicial bodies and authorities by virtue of legal obligations
• Authorized for Processing by NOWARC SRLS.

Under no circumstances do we transfer or sell personal data to third parties.

7.1. Access to personal data from your reserved area and revocation of consent

You, the user, can, at any time, view your personal data in your reserved area by entering your account and clicking on the "Edit Profile" section.
Furthermore, remember that it is always possible to revoke the consent you have provided at any time by sending an email with the subject “REVOKE CONSENT” to the address: info@nowarc.com.

7.2. Export and cancellation of the processing of personal data

To export your personal data or request its deletion you can send a request to the email address info@nowarc.com from the email address with which you registered on nowarc.com.
Your personal data will be exported within 30 days or, if the export is particularly complex, within three months.
The deletion will be carried out within the foreseen technical times and in compliance with the retention period explained in point 5 below.

7.3. Exercise your rights

Any natural person using our service can:

• obtain from the owner, at any time, information regarding the existence of their personal data, the origin of the same, the purposes and methods of processing and, if present, to obtain access to the personal data and information referred to in the Article 15 of the GDPR
• request the updating, rectification, integration, cancellation, limitation of data processing if one of the conditions provided for in Article 18 of the GDPR occurs, transformation into anonymous form or blocking of personal data, processed in violation by law, including those whose retention is not necessary in relation to the purposes for which the data were collected and/or subsequently processed
• object, in whole or in part, for legitimate reasons, to the processing of data, even if pertinent to the purpose of the collection and processing of personal data intended for the purposes of commercial information or sending of advertising or direct sales material or for the fulfillment of market research or commercial communication. Each user also has the right to revoke consent at any time without prejudice to the lawfulness of the processing based on the consent given before the revocation.
• receive their personal data, provided knowingly and actively or through the use of the service, in a structured format, commonly used and readable by automatic device, and to transmit them to another data controller without impediments
• lodge a complaint with the Guarantor Authority for the protection of personal data in Italy

We remind you that for any questions or requests relating to your personal data and respect for your privacy you can write to the dedicated address info@nowarc.com.

The storage of personal data will take place in paper and/or electronic/computer form and for the time strictly necessary to fulfill the purposes referred to in point 3, in compliance with your privacy and current regulations. In the case of active users, the announcements and content generated by the user will be kept for 36 months for reasons of security, prevention and moderation of content and/or conduct contrary to the conditions of the nowarc.com service in order to ensure a better quality of the same also in collaboration with the Authorities.

For purposes of analysis aimed at the development and improvement of the service, the user's personal data may be subject to the same retention period.

For marketing purposes we keep your data for a maximum period equal to that required by applicable law (24 and 12 months respectively).

Invoices, accounting documents and transaction data are held for 11 years in accordance with the law (including tax obligations).

In the case of exercise of the right to be forgotten through a request for express cancellation of personal data processed by the owner, we remind you that such data will be kept, in a protected form and with limited access, solely for the purpose of ascertaining and suppressing crimes, for a period no more than 12 months from the date of the request and will subsequently be deleted in a secure manner or anonymized in an irreversible manner.

Finally, we remind you that for the same purposes, the data relating to electronic traffic, excluding in any case the contents of the communications, will be kept for a period not exceeding 6 years from the date of communication, pursuant to art. 24 of Law no. 167/2017, which transposed EU Directive 2017/541 on anti-terrorism.

The data are collected by the subjects indicated in point 3, according to the indications of the relevant legislation, with particular regard to the security measures provided for by the GDPR (art. 32) for their processing using IT, manual and automated tools and with strictly related logic to the purposes indicated in point 1 and in any case in such a way as to guarantee the security and confidentiality of the data themselves. The data entered therein may be verified for the sole purpose of identifying illicit activities or contents that do not comply with the General Conditions of the Service, but will not be processed or communicated for commercial or promotional purposes.

10.1. Search engine

The information relating to advertisements placed on nowarc.com will be visible in searches carried out in the internal search engine and may be made available to third-party search engines as the indexing of contents by third-party engines is permitted. If the page relating to the announcement has already been removed from nowarc.com, it is possible that the cached copy will remain among the search results for a few days. Search results are not managed by nowarc.com, but the user can report removal of the page and request an update of the cached copy directly to the third-party search engine.

This information may be subject to changes. If substantial changes are made to the use of data relating to the user by the Data Controller, the latter will notify the user by publishing them as clearly as possible on their pages or through alternative or similar means.
